TERMS OF SERVICE
By commissioning or buying artwork from me you have automatically agreed to the Terms below, so please read through them all. You can contact me with questions or concerns via my socials or email: butterflys.draws@gmail.com.
COMMISSIONS
- I have the right to decline a commission for any reason, especially if it is against my Terms of Service.
- By purchasing a commission from me, you consent to having the completed image posted on my
social media and used as a portfolio piece (with proper credit to the character design and
commissioner). You can request for your commission to not be posted or to be anonymous (this
needs to be requested beforehand).
- The commissioner is free to post the commissioned piece to their social media/website, or print for
personal use.
- The commissioned image will NOT be used for commercial purposes, unless otherwise discussed. The
commissioned image also cannot be sold to others.
- All payments will be made through PayPal invoice in USD.
COMMISSION PROCESS
- Fill out the commission request form or contact me with details of your commission.
- After your commission has been received and accepted you will get a confirmation email or message. I will then send a thumbnail sketch to confirm the composition, lighting, and posing.
- I will then send an invoice for the commission. Once you have approved the invoice and payment is
received I will begin working on your commission as soon as possible. You will have 7 days to make
the payment at which point if you have not paid the invoice your commission will be dropped. If you
are unable to make the payment within this time contact me and we can work something out.
- Next you will receive the final sketch. This is the time to ask for corrections.
(If the commissioner asks for a new idea/pose, a fee equal to the sketch will be added.)
- You will then receive another work in progress with lineart and a base color. After this point I'll send
one to two more WIPs of the rendering progress.
- You are welcome to ask for a work in progress at any time.
- Lastly you will receive the finished piece via Google Drive. You may also request an unsigned version
for personal use.
- I am happy to correct any errors I may have overlooked of the character's design that was indicated
on the reference sheet. Minor changes are also acceptable, but major changes will incur
further charges.
ADOPTS AND CUSTOM DESIGNS
- Once the design is yours, it's yours. You are free to use the design however you want, no need to
get permission from me.
- You are welcome to alter the design however you see fit.
- You have the right to claim the design as your intellectual property. However, I retain the right to
post the original artwork (I created) anywhere on my social media.
- You do not have the right to claim the design as created by you. For custom designs you have the
right claim the idea as your own.
- You have the right to resell a design; however, it cannot be sold for more than you bought it.
- You don't have the right to create an open, semi-open, or closed species of any adopt
you've purchased from me.
BIDDING / PAYMENT / REFUNDS
- Payment is made in USD via PayPal.
- No fake bids, bid only what you can pay. No refunds on adopts.
- For commissions payment is made upfront after the initial thumbnail sketch is approved.
- Payment plans can be requested for auctions and commissions. The progress of your commission will
then correspond to the payments made.
- You can expect your commission to be completed within a week to a month after I have begun
working on it. This time varies based on the type of commission, where you are in the queue, contact
with the commissioner, and life. Larger commissions may take longer than a month.
- I cannot guarantee a commission will be done by a specific deadline; however, I will try to meet any
reasonable time frame you have in mind.
- Refunds can be requested at any time; however, full refunds are only accepted before the
commission is started (this does not include the thumbnail).
- If progress has already been made prior to cancellation, a partial refund can be issued based on the
amount of work already done.
